最近非常多的卖家朋友向我咨询如何投诉应对跟卖。而且市场上基本的各种教程基本也都无关痛痒针对关键问题避而不谈。所以我决定开篇一文,把跟卖尽可能讲个透。

如果有发现产品被跟卖,大家不要慌按照以下流程处理大部分情况都可以解决。

第一招:到卖家店铺发警告信

第二招:通过卖家后台投诉

第三招:Test buy之后再警告【买家或卖家账号发邮件均可】

第四招:通过前台举报侵权投诉【配合test buy】

第五招:通过知识产权部门投诉

第六招:品牌备案卖家专用渠道

偏方:1.邮件轰炸 2.买家号投诉

第一招:到卖家店铺发警告信

以下是警告信邮件标准版,替换对应文字即可:

  • 自己品牌名称—-A( 授权之品牌名称或是已注册之品牌名称)
  • 对方(卖家) 品牌名称—-B( 您要投诉之对象名称或是品牌名称)

警告信模板标准版

Dear “卖家”,

It has come to our attention that "B” is using the "A" trademark without license or prior written authorization from "A"“.

"A" holds federal trademark registrations in the United States. So “ B ” listings violate ” A ” trademark and intellectual property rights. You are also in breach of Amazon’s Participation Agreement.

Therefore, we demand that you immediately remove all listings on Amazon.com in which “ B ”utilizes our trademarks and images protected by copyright.

“ B ” currently has at least one listing on Amazon.com for products that utilize“ A’s” trademarks and/or copyrights without authorization. See the following ASIN:(写自己的ASIN)

” A ” is the only entity authorized to provide authorization to sell its products on Amazon.com. Your listing constitutes a violation of ” A’s ” trademark rights, copyrights, and Amazon’s Participation Agreement.

“ B ” ‘s infringing listings must be removed immediately to prevent damage to ” A ” brand and lost sales.

While ” A ” has many options available under this state. But we would prefer to resolve this matter amicably. Please confirm to us in writing within 24 hours, that you have:

Removed all of ” A’s ” trademarks and copyright material from your Amazon.com listings and any other website or public display you operate;

(2) Removed all of ” A’s ” listings of products it claims to be associated with ” A’s “, including but not limited to the ASINs listed above.

Failure to take action within 24 hours will force us to report this serious violation to the Amazon seller performance team. This is licensed products to Amazon.com as well, Amazon seller performance team will take such violations very seriously, possibly resulting in removal of your selling privileges on Amazon.com

如果警告信模板标准版不奏效,可以尝试警告信模板升级版。我把升级版邮件放在知识星球/小密圈里面,一是用的人过多就不灵了,二是防止跟卖看到来应对。有兴趣的可以进去找。

第二招:从亚马逊卖家后开case

(路径:帮助-联系我们-其他问题-举报违规行为)

投诉要点;

  • Test buy 拿到订单号和与你产品不符的图片
  • 投诉实际产品与描述图片不符,强调影响买家体验影响lisitng表现,违反亚马逊规定.
  • 如果有证书,要强调侵权并附件证书

卖家向客服投诉信模板

Please investigate this seller named ” SELLER A”

Dear Amazon,

We are the owner of “BRAND” and we have registered both on Amazon and USPTO. This seller is hurting our brand and Amzon buyer experience by selling low quality different products under the same listing and making profit without any authorization.

Please help to warn this seller named–” SELLER A”

They are infringing upon our trademark rights–”BRAND”

GCID: *************(如没有GCID提供UPC和购买UPC的证书)

Attachment is the proof of that. (质量差或者没印logo标明差异性)

It is an illegal action that seriously infringes Trademark Law,which is also against Amazon’s policy while our brand has been registered in Amazon brand registry.

如果test buy的产品是自发货,这封邮件一定要等货物发出去再发,否则自发货的卖家有可能取消订单,白白浪费时间。

第四招:通过前台举报侵权投诉【配合test buy】

投诉方法:

1. 进入链接

选择 trademark Concerns 商标问题 然后选择 a product counterfeit 假冒产品

2. 填入Additional information【要投诉的内容可以参照第二招邮件】 然后输入要投诉asin 点Go

选择要投诉的卖家

输入联系人信息,可以直接输入 卖家账号信息,没有任何影响

输入名字邮箱,确认之后即可

投诉成功后会收到如下邮件

第五招:通过知识产权部门投诉

在美国亚马逊通过商标证书投诉跟卖侵权:

需要注意的是,亚马逊由于品牌备案各个自助渠道日趋完善,这个邮箱的功能正在减弱,但是不失为一个渠道。也可以尝试。

1.商品详情页面的ASIN/ISBN和商品名称 The ASIN/ISBN of the item”s detail page and the product title

2.举报商家的店铺和公司名称 The store or business name of the seller you are reporting

3.对于违反的政策条款的简单描述 A concise explanation of the violation.

4.违规的证据(最关键的东西) Proof of the violation

5.在亚马逊美国站测试购买该商品的订单编号 Amazon.com Order ID of a test buy that confirms the violation

6.商标注册证明的复印件 Copy of your trademark registration certificate

7.商标UPC条形码的购买证明 Proof of purchase for the product’s UPC bar code

8.测试购买到的商品照片 Photos of the item(s) you received in the test buy

9.您的联系方式(包括地址、电话、邮件)Your address, telephone number, and e-mail address

10.一份关于您知道伪证处罚的声明,确保您在通知中的信息准确,确认您是该商标的持有者或者该商标的授权者

亚马逊知识产权部门投诉信模板

第六招:品牌备案卖家专用渠道

投诉链接:

投诉方法:

1.进入品牌备案的投诉页面

选择品牌名称的时候,可以批量投诉也可以单个投诉。 选择 商标侵权 专利侵权 还是 版权侵权 ; 我们选商标侵权

选择商品为假冒产品 并选择品牌

提交订单号以及信息描述 点下一步

然后输入名字电话提交即可。

偏门两招:

A. 小号购买后买家投诉 [开投诉+差评】

B. 滥发邮件 【500封估计就受不了】

跟卖的情况千奇百怪,一封邮件肯定解决不留所有问题,但是一定能解决大多数问题。
